My husband, Dean and I own a 2008 Duramax Diesel with 31,865 miles on it.  Coming home to Swanton, Ohio from Atlanta, GA our motor started knocking and stopped.  We called and had our truck and a 40 goose neck aluminum trailer towed to the closest dealer to have it fixed under warranty to get us back home.  Of course we have a aftermaket product, Banks, on the truck to get better gas milage, which we haven't, and of course GM doesn't want to warranty it because of this.  I have become familar with our rights and know they have to prove to me that the aftermarket caused this problem.  We had our family come and tow everything back home to our local dealer who has been absoultly great in helping us but say they can't do anything since GM says they won't warranty it. They did tell me though it is the crankshaft in the lower part of the motor they know for sure is broke and even if they tear down the motor they don't beleive they can really show what caused the lower motor to come about. I have talked to a specialist at GM and says because of GM bulletin  #06-06-01-007C which refers to our situation and they will not cover it.  If I am not mistaken in this bulletin is says that "Dealers should not automatically decline warranty assisatance on engine failures due to the fact that a power-up device or modification is evident or suspected.  The technician must identify that the failure is due to a power-up device by teardown analysis and diagnosis of the engine componenets".  I can't get GM to agree to this teardown and my dealer hates to charge us the $1,000 they want to tear it down when GM is still going to deny me coverage.  GM agreed that if we fix the engine (basically replace the motor for $11,000 and remove the aftermarket parts at our dealer they will put the truck back under warrenty).  Of course in this day and age we don't have that kind of money.  I know they are trying to run me around in circle and wear me down to the point I will give up but gosh darn, I won't.  I know it was not our fault nor the aftermarket product since we weren't even using it at the time.  It was just one of those motors that got through quality control at the plant manufactures and should not have.

Does anyone have any advice or suggestions as to what I should do next.  I have contacted our lawyer but they don't really deal with this stuff and I am not sure exactly what kind of lawyer to be looking for. I hate to go to that expense but don't feel I will actually have to pay anything once we get to court and GM is found at fault.
